These Terms & Conditions (“Terms”) govern your access to and use of the Chef Monique Nutrition website, content, booking links, educational materials, programs, coaching services, lab review services, digital products, recipes, and other products or services offered by Chef Monique Nutrition LLC (“Chef Monique Nutrition,” “we,” “us,” or “our”).
By accessing this website, booking a consultation, submitting an inquiry, purchasing a program or service, or otherwise using our website or services, you agree to these Terms. If you do not agree with these Terms, please do not use this website or purchase our services.

1. ABOUT CHEF MONIQUE NUTRITION
Chef Monique Nutrition LLC provides functional nutrition coaching, nutrition and lifestyle education, culinary education, meal-planning guidance, wellness programs, functional laboratory review and education, supplement education, recipes, digital resources, and related services.
Our services are intended to educate and empower individuals to make informed decisions regarding nutrition, lifestyle, and wellness.
Specific services may also be governed by a separate client agreement, informed consent, program agreement, order form, or other written agreement between you and Chef Monique Nutrition LLC. If a separate written agreement conflicts with these Terms, the separate written agreement will control with respect to those services.


2. ELIGIBILITY
By using this website or purchasing our services, you represent that you are at least 18 years old and legally capable of entering into a binding agreement.
Services for minors, if offered, may require the consent and participation of a parent or legal guardian and may be subject to additional agreements.

3. HEALTH, NUTRITION & EDUCATIONAL DISCLAIMER
Chef Monique Nutrition provides nutrition, culinary, lifestyle, wellness, and health education.
Information provided through this website, coaching, programs, consultations, lab reviews, recipes, social-media content, emails, downloads, and other materials is intended for educational and informational purposes only.
Chef Monique Nutrition does not diagnose, treat, cure, or prevent disease and does not replace care from your physician or other appropriately licensed healthcare professional.
Participation in coaching or other services does not establish a physician-patient relationship.
You should consult an appropriately qualified healthcare professional regarding medical conditions, symptoms, diagnoses, medications, treatment decisions, or changes to an existing medical treatment plan.

4. FUNCTIONAL LABORATORY TESTING & LAB REVIEWS
Chef Monique Nutrition may recommend, facilitate access to, or provide education regarding functional and conventional laboratory testing based on a client's individual goals and circumstances.
Laboratory testing may be ordered, processed, performed, or fulfilled through independent third-party laboratories, healthcare providers, or other authorized entities. Chef Monique Nutrition does not own or control these third parties and is not responsible for their testing procedures, laboratory methodology, specimen handling, processing times, accuracy, availability, policies, pricing, or other acts or omissions.
Chef Monique Nutrition may review laboratory results from a functional nutrition and wellness perspective to identify patterns and provide nutrition, lifestyle, and wellness education. Such review is not intended to diagnose disease or replace interpretation, diagnosis, or treatment by a physician or other appropriately licensed healthcare professional.
Fees associated with laboratory testing are separate from coaching or consultation fees unless expressly stated otherwise at the time of purchase.

5. SUPPLEMENTS & THIRD-PARTY PRODUCTS
Chef Monique Nutrition may provide education or recommendations regarding dietary supplements, foods, wellness products, or other third-party products based on a client's goals, history, nutritional needs, laboratory findings, or other available information.
Chef Monique Nutrition LLC does not directly manufacture or fulfill dietary supplements or other third-party wellness products offered through outside dispensaries, retailers, manufacturers, or fulfillment platforms.
Purchases made through third-party companies are subject to that company's own terms, shipping policies, return policies, refund policies, guarantees, and other conditions. Chef Monique Nutrition LLC does not accept or process returns or refunds for products purchased from third parties. Any return, replacement, refund, shipping, or product-quality request must be directed to the company from which the product was purchased.
Dietary supplements may cause adverse reactions or interact with medications, other supplements, or medical conditions. Clients are responsible for discussing supplement use with an appropriately qualified healthcare professional when indicated.

6. MEDICAL SERVICES, MEDICATIONS & LICENSED PROVIDERS
Chef Monique Nutrition LLC does not prescribe prescription medications or provide medical diagnosis or treatment through its nutrition coaching services.
When a client's circumstances may benefit from medical evaluation, prescription medication, medical treatment, or other services requiring a licensed healthcare professional, Chef Monique Nutrition may recommend or refer the client to an independent licensed medical provider or medical team.
Any medical evaluation, diagnosis, prescription, treatment recommendation, medication management, or other medical service is the responsibility of the licensed healthcare professional providing that service and is subject to that provider's professional judgment, informed-consent process, terms, policies, and applicable law.
A referral or recommendation to a healthcare professional does not guarantee that the provider will determine that any particular medication, therapy, treatment, or intervention is medically appropriate.
Unless expressly stated otherwise in writing, independent healthcare professionals and medical practices are not employees or agents of Chef Monique Nutrition LLC, and Chef Monique Nutrition LLC does not control their clinical decision-making.

7. CLIENT RESPONSIBILITY & ACCURATE HEALTH INFORMATION
Clients acknowledge that individualized nutrition and wellness recommendations depend upon the accuracy and completeness of the information provided to Chef Monique Nutrition.
Clients agree to provide accurate and complete information regarding their health history, symptoms, medications, supplements, allergies, diagnoses, laboratory results, medical treatment, pregnancy or nursing status, and other information reasonably relevant to the services being provided, and to notify Chef Monique Nutrition of material changes during the coaching relationship.
Chef Monique Nutrition may rely upon information provided by the client when developing educational recommendations. To the fullest extent permitted by applicable law, Chef Monique Nutrition LLC is not responsible for consequences arising from materially inaccurate, incomplete, omitted, or outdated information provided by a client.

8. ASSUMPTION OF RISK
Clients understand that changes to nutrition, physical activity, lifestyle practices, dietary supplements, and other wellness behaviors may involve risks and may affect individuals differently.
By choosing to implement information or recommendations provided through Chef Monique Nutrition, clients acknowledge and voluntarily assume the risks ordinarily associated with those choices and agree to seek appropriate medical guidance when necessary.
Clients should not discontinue or modify prescribed medications or medical treatment based solely upon information provided by Chef Monique Nutrition without consulting the prescribing or treating healthcare professional.

9. APPOINTMENTS & BOOKINGS
Chef Monique Nutrition may provide booking links for consultations, coaching appointments, lab reviews, or other services.
Booking an introductory or discovery call does not guarantee acceptance into a coaching program or establish an ongoing client relationship unless otherwise agreed in writing.
You agree to provide accurate information when scheduling and to attend appointments you book.
Cancellation, rescheduling, late-arrival, and missed-appointment policies may be provided at booking or contained within your individual client agreement.

10. PURCHASES & PAYMENT
Prices for coaching, consultations, lab reviews, programs, digital products, and other offerings will be disclosed at the time of purchase or enrollment.
By purchasing a product or service, you authorize Chef Monique Nutrition LLC and its payment processors to charge the payment method you provide for the agreed amount.
If you select a payment plan, you are responsible for completing all payments according to the agreed schedule. Unless expressly stated otherwise, a payment plan represents installments toward a total purchase price and is not a month-to-month subscription.
Failure to participate in or complete a purchased service or program does not automatically eliminate your payment obligations.
Additional payment terms contained in a separate client agreement will control where applicable.

11. REFUNDS, CANCELLATIONS & PAYMENT COMMITMENTS
Due to the personalized nature of Chef Monique Nutrition's coaching, consultation, lab review, educational, and wellness services, all purchases are final and non-refundable except where otherwise expressly stated in writing or required by applicable law.
This policy applies to 1:1 coaching, consultations, lab reviews, programs, digital products, educational materials, deposits, and other services purchased directly from Chef Monique Nutrition LLC.
If a program or service is purchased using a payment plan, the payment plan represents a method of paying the total agreed purchase price and is not a month-to-month membership or subscription unless expressly stated otherwise. Choosing not to participate in, attend, complete, or continue using a purchased program or service does not automatically cancel remaining payment obligations.
Fees already paid are not refundable because a client changes their mind, chooses not to participate, does not implement recommendations, misses appointments, or does not achieve a particular desired result.
Laboratory testing, supplements, and other products or services purchased from third-party companies are subject to the refund, cancellation, replacement, and return policies of those respective companies. Chef Monique Nutrition LLC does not issue refunds for purchases made directly from third parties.
Where Chef Monique Nutrition facilitates or places an authorized order with a third-party laboratory or provider on a client's behalf, cancellation or refund eligibility may be limited once the order has been submitted, a test kit has shipped, a specimen has been collected, or the third party has otherwise begun processing the order.
Any cancellation, rescheduling, termination, or payment provisions contained in a separate signed client agreement will control over this website policy where applicable.

12. INTELLECTUAL PROPERTY
Unless otherwise stated, all content and materials available through Chef Monique Nutrition—including website copy, photographs, videos, recipes, meal plans, educational materials, protocols, frameworks, worksheets, presentations, guides, downloads, graphics, program materials, and other original content—are owned by or licensed to Chef Monique Nutrition LLC and are protected by applicable intellectual-property laws.
Purchasing or accessing our content does not transfer ownership of that intellectual property to you.
Unless expressly authorized in writing, you may not reproduce, distribute, republish, sell, license, modify, teach, commercially exploit, or create derivative works from Chef Monique Nutrition materials.
Materials provided to clients are intended solely for the personal use of the individual who purchased or received them unless otherwise expressly stated.

13. PROGRAM MATERIALS & ACCOUNT ACCESS
Certain services or programs may provide access to proprietary videos, protocols, guides, recipes, worksheets, educational resources, recordings, or other materials.
Access is intended only for the purchaser unless expressly stated otherwise.
You may not share login credentials, distribute paid content, upload materials to public platforms, resell resources, or otherwise provide unauthorized access to another person.
Chef Monique Nutrition reserves the right to revoke access in cases of unauthorized distribution or misuse, subject to applicable law and any separate written agreement.

14. AFFILIATE LINKS & THIRD-PARTY PRODUCTS
Chef Monique Nutrition may recommend or link to supplements, foods, kitchen products, books, wellness products, laboratory services, or other third-party products and services.
Some links may be affiliate links, meaning Chef Monique Nutrition LLC may receive a commission or other compensation if you make a purchase through the link, at no additional cost to you.
An affiliate relationship does not change our commitment to sharing products or resources we believe may be useful to our audience.
However, third-party products and services are controlled by their respective providers. Chef Monique Nutrition does not manufacture or control those products and cannot guarantee their quality, availability, safety, effectiveness, ingredients, claims, shipping, or performance.

15. THIRD-PARTY SERVICES & LINKS
Our website may contain links to or integrations with third-party laboratories, supplement dispensaries, booking platforms, payment processors, social-media platforms, email providers, retailers, software providers, or other websites and services.
Chef Monique Nutrition does not control these third parties and is not responsible for their content, availability, privacy practices, security, policies, or actions.
Your use of third-party services may be subject to separate terms and policies established by those providers.

16. TESTIMONIALS
Chef Monique Nutrition may display testimonials, reviews, case studies, or examples of client experiences.
These reflect individual experiences and are not guarantees that current or prospective clients will achieve identical or similar outcomes.
Any use of a client's name, likeness, health information, testimonial, or story will additionally be subject to applicable consent and privacy requirements.

17. USER CONDUCT
You agree not to use this website or Chef Monique Nutrition services to violate applicable law; infringe intellectual-property or privacy rights; gain unauthorized access to our website or systems; distribute malware or harmful technology; copy or commercially exploit proprietary materials without authorization; impersonate another person; provide materially false information; or interfere with the normal operation or security of the website.
We reserve the right to restrict or terminate access where we reasonably believe these Terms have been violated.

18. WEBSITE AVAILABILITY
We make reasonable efforts to maintain our website but do not guarantee uninterrupted or error-free access.
Chef Monique Nutrition may modify, suspend, discontinue, update, or restrict portions of the website or its content at any time.
We are not responsible for interruptions caused by hosting providers, maintenance, internet or utility outages, software failures, third-party platforms, or circumstances outside our reasonable control.

19. PRIVACY & PERSONAL INFORMATION

Chef Monique Nutrition LLC may collect, use, store, and process personal information that you voluntarily provide through this website or in connection with our services, including through contact forms, scheduling platforms, questionnaires, purchases, email communications, coaching services, and other interactions.

Chef Monique Nutrition LLC may use third-party service providers to operate portions of our business, including website hosting, scheduling, payment processing, email communications, laboratory testing, supplement dispensaries, forms, analytics, and other business functions. Information shared with or collected by third parties may also be subject to their respective privacy policies and terms.
You are responsible for using reasonable care when transmitting sensitive information electronically and for maintaining the confidentiality of passwords or account credentials associated with any services you access.

20. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Chef Monique Nutrition LLC, its owner, employees, contractors, representatives, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, this website, its content, programs, products, recommendations, or services.
Chef Monique Nutrition LLC is not responsible for losses, injuries, adverse reactions, or damages resulting from the acts or omissions of independent third parties, including laboratories, healthcare professionals, supplement companies, dispensaries, payment processors, technology providers, retailers, or other third-party services.
To the fullest extent permitted by applicable law, the total liability of Chef Monique Nutrition LLC arising from or relating to a particular purchased service will not exceed the amount actually paid by you to Chef Monique Nutrition LLC for the specific product or service giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

21. INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Chef Monique Nutrition LLC and its owner, employees, contractors, representatives, and affiliates from and against claims, liabilities, damages, losses, costs, and reasonable expenses arising from or related to:
your misuse of this website, its content, programs, products, or services;
your violation of these Terms;
your infringement or violation of another person's intellectual property, privacy, or other legal rights; or
materially false, incomplete, or misleading information you knowingly provide in connection with your use of our services.
This provision does not require you to indemnify Chef Monique Nutrition LLC for liability that cannot lawfully be shifted to you.

22. FORCE MAJEURE
Chef Monique Nutrition LLC will not be responsible for delays, interruptions, or failures to perform caused by circumstances reasonably beyond its control, including natural disasters, severe weather, fire, flood, illness or incapacity, government actions, public health emergencies, internet or utility outages, labor disruptions, transportation interruptions, third-party platform failures, laboratory delays, supply-chain disruptions, or other events that materially interfere with the ability to provide services.
When reasonably possible, affected appointments or services may be rescheduled, modified, or delivered through an alternative method.

23. GOVERNING LAW & JURISDICTION 
These Terms and any dispute arising from or relating to them will be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law principles.
To the extent permitted by applicable law, any legal proceeding arising from or relating to these Terms, this website, or services provided by Chef Monique Nutrition LLC will be brought in an appropriate state or federal court located in Tennessee, and you consent to the jurisdiction of such courts.

24. SEVERABILITY
If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

25. NO WAIVER
The failure of Chef Monique Nutrition LLC to exercise or enforce any right or provision contained in these Terms will not constitute a waiver of that right or provision.
Any waiver of a provision of these Terms must be made in writing to be effective.

26. ENTIRE AGREEMENT & ADDITIONAL AGREEMENTS
These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement governing your general use of this website.
Certain products, programs, coaching relationships, laboratory services, or other offerings may be subject to additional agreements, informed consents, policies, payment terms, or conditions.
If you enter into a separate written agreement with Chef Monique Nutrition LLC concerning a particular service and a provision of that agreement conflicts with these Terms, the separate written agreement will control with respect to that service.

27. CHANGES TO THESE TERMS
Chef Monique Nutrition LLC reserves the right to update or modify these Terms periodically to reflect changes to our website, offerings, business practices, or applicable requirements.
Any revised Terms will be posted on this website with an updated “Last Updated” date.
Unless otherwise required by law, changes will become effective when posted. Your continued use of the website following the effective date of revised Terms constitutes your acceptance of those Terms.
